This site is run by me, Darby MacLellan, as a sole consultancy based in Toronto, Canada. This policy explains what personal information this website collects, why it is collected, and what I do with it. I collect as little as the site needs to function and nothing that I do not have a use for.

This website collects personal information to power its site analytics, including:

Site usage details such as pages visited, clicks, and timestamps
This information is collected in aggregate to understand how the site is used and to keep it working properly. It is not used to build a profile of you or to make decisions about you.

This website uses cookies in two categories.
Necessary cookies. These necessary and required cookies are always used, which allow Squarespace, my hosting platform, to securely serve this website to you. The site cannot function without them.
Analytics and performance cookies. These analytics and performance cookies are used on this website only when you acknowledge the cookie banner. You can decline them and the site will continue to work normally.

Information you provide
When you submit information to this website via the contact form, I collect the data requested in that form in order to track and respond to your enquiry. That is typically your name, your email address, and whatever you choose to write in the message.
I use this information to reply to you and, where a conversation leads to work, to correspond about that work. I do not add you to a mailing list, I do not send marketing emails, and I do not sell, rent, or trade your information to anyone.
Who else handles this information
I use a small number of service providers to run the site and my correspondence. They process information on my behalf and are not permitted to use it for their own purposes:
Squarespace — website hosting, form submissions, and site analytics
My email provider — receiving and storing correspondence you send me
Some of these providers store or process data outside Canada, including in the United States. Where that happens, the information may be accessible to courts and law enforcement in those jurisdictions under their local laws.
How long information is kept
Form submissions and related correspondence are kept for as long as they are useful to the enquiry or engagement, and generally no longer than two years after our last contact, unless a professional or legal obligation requires me to keep them longer. Analytics data is retained in aggregate.
How information is protected
Access to form submissions and correspondence is limited to me. Accounts are protected with strong, unique credentials and multi-factor authentication. No system is perfectly secure, but I take the safeguarding of client and enquirer information seriously and treat it as confidential.
Your rights
Under Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), you have the right to:
Ask what personal information I hold about you
Ask for a copy of it
Ask me to correct anything inaccurate
Ask me to delete it, where I have no ongoing need or legal obligation to keep it
Withdraw consent to my holding it, subject to any legal or contractual limits
Complain to the Office of the Privacy Commissioner of Canada if you are not satisfied with how I have handled your information
If you are in the United Kingdom or the European Union, you may have equivalent or additional rights under the UK GDPR or the GDPR. I will honour those requests on the same basis.

Children
This website is not directed at children and I do not knowingly collect personal information from anyone under the age of 16.
Changes to this policy
If this policy changes, the updated version will be posted here with a new date at the top. Material changes will be noted on the site.
